With high expectations to successfully meet and comply with CMS Meaningful Use program requirements, our organization recognized the need for a very proactive approach to Meaningful Use attestation preparedness. Our interest was going beyond our internal validation of the measurements and criteria prior to attesting, and extending preparedness to include having audit ready documentation on-the-shelf for the hospital and all eligible providers. The goal was to increase our confidence in all MU attestations, and reduce the financial risk of future non-compliance penalties, regardless of who in our organization may be asked to respond to a future audit request.
We selected the services of Jim Tate and his team at EMR Advocates, to help us prepare for and perform a mock CMS audit. After assembling and reviewing our on-the-shelf documentation with the help of Jim’s team, he completed a very thorough mock audit using a process similar to what we’d expect from CMS. During the documentation review and mock audit process we did find some documentation deficiencies that needed correction or additional data, and were able to have them corrected prior to attesting
Shortly after submitting the last attestation for our approximately 75 providers, we received notice that 33 of them were selected for pre-payment audits. Thanks to the help that Jim’s team had previously provided our internal audit and Meaningful Use team, we very efficiently and quickly responded to the audit requests. The CMS audit contractor we worked with was professional and helpful during the audit process, and we’re pleased that all our providers were approved for Stage 2 Meaningful Use payments.
We were fortunate to have Jim’s team help in the development of our attestation and audit preparedness program, and although we didn’t expect we’d be validating the quality of our audit preparedness quite this quickly, we are very pleased with the outcome. I arrived at DMH in May of 2014 and learned in August of 2014 that the audit was heading down a bad path. At that time, we requested several extensions from the audit firm Figliozzi. & Co. My team and I communicated often about the audit process and the steps we were taking to address all issues raised. It wasn’t long before we realized that Core Measure 14 was going to be problematic. Needless to say, we failed the audit because Core Measure 14, according to Figliozzi, fell outside of the required measures. After we learned from Figliozzi & Company that we failed the audit, we also learned of Jim Tate and his firm. We contacted Jim and requested information including references. Most of the references I received were from Texas. I spoke to four different individuals in Texas about Jim and his company. The information/insight I was given by the references was excellent and at that point I informed my hospital board along with the county governmental body that I would be using Jim’s firm to assist us with the appeal. I spoke to Jim about the appeal on two different occasions before it was filed and each time I learned something new about the process. Excerpt: “In May 2013 a demand letter from CMS was received by our hospital requesting recoupment of $1,014,764 for the Medicare portion of our Meaningful Use payment. CMS requested full payment by June 27, 2013. It was at this time we engaged the services of Mr.Tate and EMR Advocate. Mr. Tate was very helpful to us with the preparation of a formal appeal to CMS. On June 24, 2013 we were notified by CMS that the adverse audit decision was being overturned and we did not have to return the 2011 EHR Incentive Payment. I would recommend the services of Mr. Tate and EMR Advocate in the event your facility is notified that it will be subject to a Meaningful Use audit or your facility is audited, or you have an adverse outcome and need to file an appeal.”
